Terms of Sale

Article 1 — Purpose

These Terms of Sale govern the booking and purchase conditions of motorcycle trackday spots via the tarmago.com platform, operated by JOH Consulting (hereafter « Tarmago »). Tarmago acts as an intermediary connecting trackday organisers and riders. By placing an order, the user acknowledges having read and accepted these Terms.

Article 2 — Booking

Bookings are confirmed once paid in full via Stripe. A confirmation email is sent automatically to the address provided. The spot is guaranteed upon receipt of payment. Users can book as a logged-in member or as a guest checkout. Each participant must hold their own booking.

Article 3 — Prices

Prices are displayed in euros, taxes included. They include the Tarmago commission (7% incl. tax on the spot price and options, excluding insurance). Optional insurances are paid in full to the organiser (0% commission). Event creation and registration on Tarmago are free for organisers.

Article 4 — Payment

Payment is made by card via Stripe (3D Secure authentication). Funds are held by Tarmago until the day after the event (D+1), at which point they are paid to the organiser via Stripe Connect. Tarmago stores no card data.

Article 5 — Right of withdrawal

Under article L221-28 of the French Consumer Code, the right of withdrawal does not apply to leisure services to be provided on a specified date. Trackday bookings being leisure services on fixed dates, they are excluded from the right of withdrawal. Users are informed of this and explicitly accept it when validating their order.

Article 6 — Cancellation by the rider

Although the right of withdrawal does not apply, every organiser sets a cancellation policy displayed on the event page before purchase. Three possible policies:

  • Flexible: cancellation possible up to D-7, 100% credit
  • Moderate: cancellation possible up to D-14, 100% credit
  • Strict: cancellation possible up to D-30, 100% credit

Any cancellation outside these windows entitles you to no refund or credit.

Article 7 — Credits

When a cancellation is made within the deadlines, a full-amount credit is added to your Tarmago account. Credits are valid for 12 months from creation and usable on any Tarmago booking. When a credit covers 100% of a new booking's amount, no card payment is required. If the credit is partial, only the difference is charged to the card. Credits are non-cashable and non-convertible into money.

Article 8 — Cancellation by the organiser

If an event is cancelled by the organiser, a full refund is automatically processed to the card used at payment via Stripe. For bookings paid by credit, a new credit of the same amount is re-issued. The organiser commits at publication time to a flat €50 penalty if cancellation occurs after bookings have been confirmed.

Article 9 — Liability

Tarmago is a technical intermediary connecting parties. The organiser is solely responsible for the running, safety, supervision and regulatory compliance of the event. Riders are responsible for their gear, physical fitness, compliance with safety rules and verification that their level matches their chosen group. Tarmago cannot be held liable for any bodily, material or immaterial damage during a track day.

Article 10 — Minors

The use of Tarmago and the booking of track days are reserved for adults (18 years old and over). By creating an account and making a booking, the user declares being 18 years old or older.

Article 11 — Personal data

Personal data collected as part of bookings is processed in line with our Privacy Policy available at tarmago.com/fr/confidentialite. Privacy policy

Article 12 — Mediation

Under articles L611-1 et seq. of the French Consumer Code, in case of a dispute not resolved by Tarmago's customer service (contact@tarmago.com), consumers may resort free of charge to a consumer mediator. Article 13 — Force majeure

Tarmago cannot be held liable for non-performance of its obligations in case of force majeure as defined in article 1218 of the French Civil Code, including natural disasters, epidemics, generalised internet outages, government decisions or any circumstance beyond Tarmago's reasonable control.

Article 14 — Tarmago's reservations and abuse cases

Tarmago reserves the right, at any time and without prior notice or compensation, to cancel, suspend or refuse any order, user account or platform access in the following cases, this list being non-exhaustive:

  1. Manifest attempt at fraud, circumvention of pricing terms or exploitation of a technical flaw of the platform, including if a booking resulted in a void or incomplete transaction without proper financial counterpart.
  2. Behaviour adversely affecting the platform's proper operation or the integrity of other users (organisers and pilots alike), particularly serial bookings followed by mass cancellations, identity fraud, or abusive use of discount codes and credits.
  3. Failure to comply with these Terms of Sale, the User Terms, or any applicable legal or regulatory provision.
  4. Manifestly erroneous information provided by the user during registration or booking (false name, false email, false identity, etc.).

Where this article applies, Tarmago may:

  • Cancel the booking without refund (in particular in case of exploitation of a technical flaw or void transaction);
  • Block the user account temporarily or permanently;
  • Retain sums already collected as a contractual penalty for the harm suffered (notably administrative time and reputation damage);
  • Initiate any legal action or prosecution that Tarmago deems necessary to repair the harm suffered.

The user acknowledges that the implementation of this article shall not give rise to any compensation for the user or third parties.

Article 15 — Terms modification

Tarmago reserves the right to modify these Terms at any time. The applicable Terms are those in force when the user validates their order. Any substantial change will be notified by email to registered users.

Article 16 — Severability

If any clause of these Terms is declared null or unenforceable by a competent court, the remaining clauses remain fully in effect.

Article 17 — Applicable law and jurisdiction

These Terms are subject to French law. In case of dispute, and after attempt at amicable resolution, the courts of Bordeaux shall have sole jurisdiction.
